7.01 GENERAL DIVISION: NON-JURY CASES (CIVIL)

Persons setting a matter for evidentiary hearing shall set such matter by motion on the motion call. Matters can also be set on the motion call by the assigned judge.

7.02 GENERAL DIVISION: JURY CASES (CIVIL)

A.  Boone County

Any information concerning status of a jury case shall be communicated to the assigned trial judge. If the judge is unavailable, the circuit clerk shall be notified of the status.

B.  Winnebago County

  1. The procedure for setting jury cases shall be provided by general order. (See General Order 2.05)
  2. No general division civil action set for jury trial shall be removed from the trial list, except upon:
    1. Settlement and the presentation of an order to dismiss; or
    2. Motion presented to the assigned judge or chief judge by the Thursday prior to trial; or
    3. Jury waiver by all parties; or
    4. Other action pursuant to Supreme Court Rule.
  3. Information concerning the pending status of a jury case shall be immediately communicated to the chief judge's office by the parties of record.
  4. The chief judge may reassign any case for trial.

7.04 GENERAL DIVISION: CONTESTED MOTIONS - WINNEBAGO COUNTY

Contested motions which have been served upon all parties in accordance with Supreme Court Rules shall be heard before the assigned judge by filing a motion slip Appendix F Appendix F and Appendix G Appendix G in the office of the circuit clerk, general division, by 12:00 noon of the day before the motion is to be heard. (See General Order 3.02)

7.05 County Division: Jury Procedural Rules - Winnebago County

A.  Jury Pre-Trial Conferences

All matters set for jury trial will follow a pre-trial conference schedule established by general order.

B.  Pre-Trial Motions

Pre-trial motions shall be filed within twenty-one (21) days after the initial pre-trial conference, but for good cause shown may be filed at a later date by leave of court.

C.  Motions for Continuance

1.  Criminal Trials

After a case has been set for trial, any motion for continuance must comply with the Code of Criminal Procedure 725 ILCS 5/114-4. Appendix B Appendix B

2.  Civil Trials

After a case has been set for trial, any motion for continuance must comply with Supreme Court Rule 231.

7.06 SCHEDULING (BOONE AND WINNEBAGO COUNTY)

At the discretion of the chief judge, the court administrator and criminal case facilitator has scheduling authority circuit wide.
