  PART 1.00  Adoption and Use of These Rules


1.01 POWER OF COURT TO ADOPT RULES

These rules are promulgated pursuant to Section 1-104 (b) of the Code of Civil Procedure providing that the circuit court may make rules regulating its dockets, calendars and business and Supreme Court Rule 21 (a) providing that a majority of the circuit judges in each circuit may adopt rules governing civil and criminal cases consistent with rules and statutes.the Court.

1.02 SCOPE OF RULES

Except as otherwise provided, these rules are made effective October 1, 1991, and shall be implemented and read in conjunction with the Constitution of the United States, Constitution of Illinois, Illinois Compiled Statutes, Illinois Supreme Court Rules, Administrative Orders of the Supreme Court of Illinois, and the General Orders of the 17th Judicial Circuit.


These rules govern circuit-wide unless designated for a specific county

1.03 EXISTING RULES REPEALED

All prior Rules of the Circuit Court for the 17th Judicial Circuit are hereby repealed.

1.04 AMENDMENTS OF RULES

Any amendment of these rules shall be passed by a majority vote of all circuit judges of the 17th Judicial Circuit.

1.05 WAIVER OF RULES

Any order entered contrary to any of the provisions of these rules shall be deemed to be a waiver thereof to the extent it so conflicts. The judge entering such an order shall provide a stated reason for the waiver.

1.06 COPIES OF RULES

Copies of these rules shall be kept on file with the circuit clerks' office, chief judge, presiding judge of Boone County, judges of the 17th judicial circuit, court administrator, bar associations and county law libraries of Boone and Winnebago Counties.

The court administrator shall maintain the rules as permanent court records, which shall be available for inspection as public documents. Copies shall be available from the court administrator for a nominal fee.

1.07 DEFINITION OF TERMS

1. Notice to Parties
In all cases where these rules require notice to parties it shall be sufficient to serve such notice on the attorney of record for any such party.
